Liquid Vitality Terms and Conditions
Entering into an agreement to purchase services from Rachael Granshaw trading as Liquid Vitality, ABN: 18 831 159 417, (“Liquid Vitality”) is conditional upon your acceptance of the following Terms and Conditions.
We urge you to take the time to peruse and review the below Terms and Conditions, which relate to your purchase of services from Liquid Vitality.
These terms and conditions govern the use of services provided by Liquid Vitality.
By using Liquid Vitality’s services, you agree to be bound by these terms and conditions. Liquid Vitality reserves the right to modify these terms and conditions at any time, and such modifications will be effective immediately upon posting on our website or other communication to you.
1. Services
We confirm that Liquid Vitality offers the following:
a. The provision of a variety of intravenous (“IV”) infusion therapy and Intramuscular ("IM") services designed to enhance wellness, improve hydration, and deliver essential vitamins and nutrients. IV infusion therapy services involve the inserting of a needle into a client’s vein followed by the injection of a prescribed solution into the client’s vein.
b. Services including, but not limited to:
i. Hydration therapy;
ii. Vitamin and mineral infusions; and
iii. Specialised nutrient therapy.
c. Services which are all administered by licensed healthcare professionals who follow stringent protocols to ensure the highest standards of care.
(“Services”)
2. Eligibility
Services are available to individuals aged 18 years and above only.
By booking an appointment, you confirm that you meet this age requirement. The Services offered by Liquid Vitality are not intended for, and should not be used by, children under the age of 18 years.
Clients must also provide accurate health information during the initial consultation to ensure that the chosen therapy is suitable for their health status.
3. Consent
Prior to receiving any of the services offered by Liquid Vitality, clients must first provide Liquid Vitality with informed consent.
This process involves a comprehensive discussion with Liquid Vitality’s healthcare professionals about the Services, the procedure, the potential risks, and the potential benefits. The process also involves clients signing and dating a Liquid Vitality Consent Form.
Clients are encouraged to ask questions and express any concerns they may have about the Services.
The Liquid Vitality Consent Form must be signed and dated by a client before any of the Services can commence.
4. Payment
Clients are required to pay for Services at the time that the Services are provided.
Liquid Vitality accepts various forms of payment including cash, credit/debit cards, and other electronic payment methods as specified on our website. We confirm that our website’s address is www.liquidvitality.com.au (“our website”).
Prices for Services are subject to change and clients will be informed of any price changes prior to their appointment.
When purchasing products and/or services from Liquid Vitality, you agree to purchase the Services for the purchase price stated on our website or provided directly to you by Liquid Vitality.
You must pay the purchase price within the stated timeframe on the invoice provided to you by Liquid Vitality or, where a deposit has been paid, the balance of the purchase price must be paid prior to providing you with the Services.
The invoice provided to you by Liquid Vitality is the entire agreement between yourself and Liquid Vitality in respect of the sale and purchase of the Services. All representations, communications and any prior agreement in relation to the sale and purchase of the Services are merged in and superseded by the invoice.
Package deals and membership discounts may be available and will be communicated as applicable.
5. Cancellation Policy
Clients must cancel or reschedule appointments for Services at least 24 hours in advance of the time that the Services are to be provided.
Failure to do so may result in a cancellation fee equivalent to any deposit made or $50.00, whichever is greater.
This policy ensures that appointment slots remain available for other clients and allows Liquid Vitality to manage resources efficiently.
Deposits are non-refundable if the cancellation policy is not adhered to.
6. Client Medical History and Future Medical Changes
A medical history will be requested from every client prior to their first appointment.
All information provided by a client concerning their medical history is confidential – please refer to our privacy policy (referred to at Clause 8 below) for more information. It is the client’s responsibility to inform Liquid Vitality of any changes to their medical information.
Clients are required to inform Liquid Vitality in advance of their appointments about any medical conditions or allergies they may have, as this information is crucial for ensuring a safe and suitable session.
Please note that if any relevant information has not been shared prior to an appointment, and this information means that an appointment cannot proceed, a 100% cancellation fee may apply if Liquid Vitality is unable to customise a new treatment for the client.
If Liquid Vitality’s nurse/s cannot proceed with the scheduled services due to:
a. A client’s existing or past medical history or condition.
b. Unforeseeable circumstances beyond the nurse’s control after the IV needle has been inserted, the client will incur a 100% charge of the infusion cost.
7. Limitation of Liability
To the full extent permitted by law and except for any liability arising from contrary agreement, Liquid Vitality will in no event be liable to you on any legal basis (including without limitation, negligence) for any loss or damage whatsoever, including (without limitation) for any adverse reactions or complications arising from IV infusion therapy and/or the Services provided by Liquid Vitality.
Clients assume all risks associated with the Services provided by Liquid Vitality.
Our healthcare professionals take all necessary precautions to minimise risks, but clients should disclose all relevant medical history and current medications to mitigate potential complications.
In case of any emergencies, appropriate medical intervention will be provided.
The above limitation applies to both direct and indirect damages.
Liquid Vitality does not warrant that the Services will meet any specific requirements or that they will be uninterrupted or error-free.
If the governing law (see Clause 11 below) implies warranties or conditions, or imposes obligations or liability on Liquid Vitality that cannot be wholly or partly excluded, restricted or modified, Liquid Vitality’ liability is limited, to the full extent permitted by the applicable legislation to the refund of the costs of the Services.
The Trade Practices Act 1974 (Cth) and the corresponding State fair trading legislation restrict the limitation of liability in certain circumstances, such as a contract for the supply of goods or services of a kind ordinarily acquired for personal, domestic, or household use.
8. Confidentiality
Liquid Vitality adheres to strict confidentiality policies to protect client information.
All personal and medical information is recorded in the database provided by Halaxy and is subject to the Privacy Policy as set out by Halaxy.
This includes data protection measures in compliance with local regulations to safeguard the privacy and security of client information.
By proceeding with your purchase of or services from Liquid Vitality, you will be deemed to have accepted our Privacy Policy, as referred to above.
9. Compliance
Liquid Vitality complies with all relevant Queensland and Australian federal regulations, including those set by the Australian Health Practitioner Regulation Agency (“AHPRA”) and the Therapeutic Goods Administration (“TGA”).
Our healthcare professionals are fully licensed and trained to adhere to these regulations, ensuring that all services meet the highest standards of safety and efficacy.
10. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable under the governing law (see Clause 11 below), it shall not affect the validity or enforceability of the remainder of these Terms and Conditions.
11. Governing Law and Jurisdiction
The laws of the State of Queensland and the Commonwealth of Australia govern these Terms and Conditions.
By accepting these Terms and Conditions, you subject to the non-exclusive jurisdiction of the courts of the State of Queensland and the Commonwealth of Australia.
12. Dispute Resolution
Any disputes between you and Liquid Vitality must be resolved under this clause.
If you have any concerns regarding the Services provided by Liquid Vitality, we ask that you raise these concerns with us first using the contact information below.
In the event that a resolution satisfactory to you and Liquid Vitality cannot be reached, the parties must refer any dispute to mediation by a Queensland Law Society Approved Mediator agreed by you and Liquid Vitality.
13. Terms and Conditions Update
These Terms and Conditions represent our policy as of (17.12.2024).
Liquid Vitality reserves the right to amend these Terms and Conditions at any time.
Clients are encouraged to review these Terms and Conditions periodically to stay informed of any changes.
Continued use of our Services after such modifications constitutes acceptance of the amended Terms and Conditions.
Liquid Vitality may change these Terms and Conditions from time to time.
